United Arab Emirates: how residence and citizenship work

Residence tests, reporting duties, social security, living base and citizenship for United Arab Emirates, with the official source for each.

Short answer

Since 1 March 2023, Cabinet Decision No. 85 of 2022 sets three ways for an individual to be a UAE tax resident: 183 days of presence in 12 consecutive months, 90 days plus a status and a home or work link, or a usual place of residence and centre of interests in the UAE. The FTA notes that being tax resident does not by itself mean a person is subject to Corporate Tax.

How United Arab Emirates decides tax residence

Each test is recorded separately with its own ID. Meeting or missing one test does not settle residence on its own.

183-day physical presence test

A natural person is a UAE tax resident if physically present in the UAE for 183 days or more within the relevant 12 consecutive months. Any day or part of a day of presence counts, and the days need not be consecutive. Days caused by exceptional circumstances beyond the person's control may be disregarded by the Authority.

90-day test with status and link

A natural person present for 90 days or more within the relevant 12 consecutive months is also resident if he is a UAE national, holds a valid UAE Residence Permit or is a national of a GCC member state, and either has a Permanent Place of Residence in the UAE or carries on employment or Business there. A permanent place of residence can be rented and must be continuously available.

Usual place of residence and centre of interests

A natural person is resident if the usual or primary place of residence and the centre of financial and personal interests are in the UAE. Ministerial Decision No. 27 of 2023 describes the usual residence as where the person habitually spends most time as part of a settled routine, and the centre of interests by reference to occupation, family and social relations, place of business and where property is administered.

Reporting duties to check

  • Tax Residency Certificate. A person who meets Article 3 or 4 of Cabinet Decision No. 85 of 2022 may apply to the Federal Tax Authority for a Tax Residency Certificate. Where a tax treaty sets its own residency conditions, the treaty conditions apply for that treaty. Source
  • Corporate Tax registration for natural persons with Business. The FTA guide states that a natural person is within Corporate Tax only where Business or Business Activity conducted in the UAE has Turnover above AED 1 million in a Gregorian calendar year. Employment income alone is treated differently. Source

Living base

The right to live in the UAE comes from a Residence Permit issued by the competent authorities, which the Cabinet Decision distinguishes from temporary entry permits for travel, tourism or medical treatment. Holding a residence permit is one condition of the 90-day test but does not by itself make a person tax resident.
