How Hungary decides tax residence
Each test is recorded separately with its own ID. Meeting or missing one test does not settle residence on its own.
Hungarian citizens
Under Section 3(2) of the Personal Income Tax Act (Act CXVII of 1995), a Hungarian citizen is a resident private individual, except a dual citizen who has no registered address in Hungary. NAV guidance notes that a Hungarian citizen can stay resident under Hungarian law while living and working abroad for several years, and may at the same time be resident in the other country, in which case the tax treaty decides.
EEA nationals: 183 days in a calendar year
A person who exercises the right of free movement and residence, mainly an EU or EEA national, is resident if they exercise that right in Hungary for at least 183 days in the calendar year. The government's information sheet on the OECD portal states that the day of entry and the day of exit are included in the count.
Third-country nationals with long-term residence status, and stateless persons
A third-country national who holds long-term (permanent) residence status under Hungary's immigration rules is resident, as is a stateless person.
Others: permanent home, centre of vital interests, habitual residence
A person not covered by HU-RES-01 to HU-RES-03 is resident if their only permanent home is in Hungary. If they have no permanent home, or have one in Hungary and another country, they are resident if their centre of vital interests, meaning their closest personal, family and economic ties, is in Hungary. If that cannot be determined, they are resident if their habitual residence is in Hungary. A permanent home is where the person has settled to live long term and actually lives, and a temporary longer stay abroad does not change it.
Arriving, leaving and part years
Residence can change within a tax year when a person's circumstances change, and income earned before and after the change is taxed differently; NAV's example uses the tax treaty to set the date of change. NAV guidance also says a person leaving Hungary permanently may ask NAV to assess their tax by formal decision ahead of the usual schedule, under Section 148(1) of the Act on the Rules of Taxation; check with NAV how that interacts with the annual return.
Social security
Hungary applies the EU rules on social security coordination: a person is generally covered by one country's system at a time, and a PD A1 form can show continued home-country cover during a temporary posting. Check national contribution rules with NAV and the Hungarian social security authorities.
Living base
EU citizens can stay in Hungary for up to three months without registering and may need to register for longer stays; after five years of continuous lawful residence they acquire the right of permanent residence. Non-EU nationals generally need a visa or residence permit, handled by the National Directorate-General for Aliens Policing. A residence permit alone does not decide tax residence, although long-term residence status is one of the tests in HU-RES-03.
How visas, permits and tax residence differ
Citizenship
Hungarian citizenship is acquired mainly by descent or by naturalization after a period of lawful residence, with other routes set by national law. Hungarian citizenship itself is a tax residence test (HU-RES-01), with an exception for dual citizens without a registered Hungarian address. This record has not verified the current naturalization residence period; check the competent Hungarian authority's current guidance.
Questions to take to a professional
- Am I a Hungarian citizen, a dual citizen with or without a registered Hungarian address, an EEA national, or a third-country national with long-term residence status?
- If I am an EEA national, how many days, counting entry and exit days, have I exercised my residence right in Hungary in the calendar year?
- Where is my permanent home, and where is my centre of vital interests if I have homes in more than one country?
- Does another country also treat me as tax resident, and how does the tax treaty with Hungary decide my residence?
- If my residence changed during the year, on what date did it change and how is my income split?
- If I am leaving Hungary permanently, should I ask NAV to assess my tax by decision, and what does that involve?
